Where does an eviction begin?

When a tenant is in breach of the lease agreement, for example, by not paying their rent or failing to maintain the rental property, you (the property owner) may put the tenant on terms by sending them a Letter of Demand.

If the tenant fails to adhere to the LOD, you will need to jump through a few legal hoops to evict the problematic tenant. First off, you need to get a court order that officially says it’s time for the problematic tenants to pack their bags and leave. To get that order, property owners have to follow the rules laid out in the Prevention of Illegal Eviction and Unlawful Occupation of Land Act, 1998 (Act No. 19 of 1998). This law is tied to Section 26 of the Constitution of the Republic of South Africa, Act 108 of 1996, which basically says the court has to take into account the personal circumstances of those illegal occupants. They want to make sure the court’s decision is not just fair but also reasonable.

Now, here’s the kicker. Eviction applications can get pretty technical, so in most cases, you’re going to want a lawyer to handle the nitty-gritty stuff. That’s where AutoEvict comes in.
